How long will my divorce take?
Under the Divorce, Dissolution and Separation Act 2020 there is a minimum period of 20 weeks between the start of the divorce process and the granting of a Conditional Order. Therefore, it is likely your divorce will take a minimum of six months to complete. This is, however, influenced by whether you and your spouse can work out a financial settlement and arrangements for your children amicably between yourselves. In cases of high net worth divorce, or where there are issues around domestic abuse and/or disputes related to children, the divorce process can last much longer. Can you help me if the local authority has threatened to remove my children?
Most people who receive a visit from their local authority regarding the care of their children are terrified that their children will be removed and taken into care. This cannot be done without a Court Order; however, if social workers feel your children are in immediate danger, the police can remove them and place them in protection for up to 72 hours.
