Below are some of the most common questions we receive from clients about our family law practice.
How long will my divorce take?
If you and your spouse can work out a financial settlement and arrangements for your children amicably between yourselves, your divorce may be completed in around six months. However, high net worth divorce, issues around domestic abuse, and disputes related to children can make the process much longer. We are committed to resolving your divorce as quickly as possible but not at the expense of you getting the outcome you want.
I have heard the law on divorce will change in April 2022 – should I wait until then to file proceedings?
The Divorce, Dissolution and Separation Act 2020 comes into force in April 2022. It removes the requirement to prove fault, i.e adultery, unreasonable behaviour, or desertion. Instead, one or both parties simply need to provide a statement that the relationship has irretrievably broken down and wait out a notice period of 26 weeks. The new legislation also removes the right for one party to contest the other’s wish to divorce or end their civil partnership.
Our Divorce Solicitors will advise you on whether it is in your best interests to delay your divorce until the new law comes into effect. If your separation is amicable and free from disputes around children and money, you may wish to delay. However, in cases where there is domestic abuse and/or a high level of animosity, it may be best to get the process underway as quickly as possible.
Can you help me if the local authority has threatened to remove my children?
Most people who receive a visit from their local authority regarding the care of their children are terrified that their children will be removed and taken into care. This cannot be done without a Court Order; however, if social workers feel your children are in immediate danger, the police can remove them and place them in protection for up to 72 hours.
Our specialist Care Proceedings Solicitors understand how the local authorities work and will fight on your side to ensure your children remain in your care. The most important thing is to contact us as soon as Social Services become involved with your family.
