What does it mean to exchange contracts?
The seller and the buyer’s Solicitors will each prepare contracts for their client to sign. Once all the title and property searches have been completed and questions provided by you and the other party are answered, the Solicitors will ‘exchange’ contracts for signing. Once contracts are exchanged you and the other party are legally required to complete the transaction. If one of you fails to do so, compensation will be sought by the wronged party.
How long will my property transaction take?
Normally it takes around 12 weeks for the sale or purchase of a residential property to complete. However, if you are in a chain or the transaction is particularly complicated it may take longer. Events such as the Coronavirus pandemic can also cause delays due to a shortage of staff in banks and local authorities.
Should I invest in property searches?
We highly advise that you have the following property searches done:
- Water and drainage
- Local authority
- Environment search
Depending on the location of your new property, we may also recommend a:
- Chancel repair liability search
- HS2 search
- Flood risk report
Property searches can save you a great deal of disappointment, frustration, and money that comes with finding out there are problems associated with your new home. Most issues can be picked up from a title search and general property searches. We would also recommend you invest in a HomeBuyers Report (as a minimum) to check for any defects in the property.
What does it mean if there are restrictive covenants listed on the title of the property I plan to buy?
A restrictive covenant imposes a constraint on how you can use your land so that the value and enjoyment of adjoining land are preserved. For example, the title might include a covenant stating that you cannot keep poultry on your land or run a business from the property.
Restrictive covenants are often present on the title of properties located on a new-build estate. This is to ensure certain standards are maintained and the value of neighbouring properties are not diminished due to the actions of one homeowner.
Restrictive covenants run with the land. This means that if you are selling your property and there are restrictive covenants listed on the title, they will bind the new owner.
