The Children Act: Custody and Welfare Guide

Our team possesses an extensive and deep understanding of the Children Act 1989, ensuring that we strictly follow the principle outlined in Section 1 of the Act, which states that the welfare of your children will always be our top priority. We are dedicated to putting your children’s best interests first in every matter.

We provide expert advice and assistance in the following areas:

  • Child Arrangements Orders, determining where the children will reside and how frequently they will have contact with the other parent.
  • Child care matters, particularly when Children’s Services have become involved.
  • Adoption procedures.
  • Relocating a child outside of the UK (removal from jurisdiction).
  • Parentage declarations.
  • Parental Responsibility disputes.
  • Assisting extended family members, such as grandparents, in relation to contact and/or caring for the children.

In cases of family crises, the Local Authority may intervene to safeguard children. If this occurs, we can support you. With our considerable experience in this area, we aim to offer practical, sensible advice to help prevent Court proceedings where possible, focusing on keeping families united. We fully understand the anxiety caused when Children’s Services are involved, and we stress the importance of seeking advice promptly.

Legal Aid is available to parents whenever the Local Authority seeks a Court Order that affects their legal rights concerning their children. This is often an extremely stressful and upsetting time. Regardless of your relationship with the children, our goal is to offer comprehensive representation and support. We are committed to providing clear guidance and compassionate advice during what is understandably a challenging time for you and the children involved.
